These General Terms and Conditions govern access to and use of the nauticas.ch website and related online services made available by Nautica’s Services SAGL, with registered office in Via Pianon 3, 6934 Bioggio, Switzerland, telephone 091 605 33 00, e-mail info@nauticas.ch.

By accessing the site, registering a user account, using the available features or making a reservation through the site, the user declares that he has read, understood and accepted these General Terms and Conditions. If you do not agree to these terms, please do not use the site and its services.

1. Purpose of the site and services

The purpose of the nauticas.ch website is to present the services offered by Nautica’s Services SAGL and to provide registered users with an online system for consulting their account, managing available credits and booking boats in accordance with the procedures established by the company.

The site does not constitute an e-commerce and does not necessarily provide for the direct online purchase of products, packages or credits. Any credits, packages or services can be purchased or agreed upon outside the website and subsequently manually uploaded to the user’s account by the authorized team of Nautica’s Services SAGL.

2. Registration of the user account

To access certain features of the site, including the consultation of credits and the reservation of boats, the registration of a user account may be required.

The user undertakes to provide correct, complete and up-to-date data during the registration phase and to promptly communicate any material changes.

The user is responsible for keeping his/her access credentials safe, and undertakes not to disclose them to third parties. Any activity that occurs through your account will be deemed to be traceable to you, unless proven otherwise.

Nautica’s Services SAGL reserves the right to suspend, limit or deactivate an account in the event of improper use, violation of these Terms and Conditions, incorrect data, conduct contrary to good faith or technical, organizational or security needs.

3. User Credits

The site may display a balance of available credits within the user account. These credits can be used, according to the conditions established by Nautica’s Services SAGL, to make reservations or use certain services.

Credits are not necessarily purchased directly through the site. They may result from agreements, packages, purchases, promotions, subscriptions or other conditions agreed outside the website and are uploaded manually by authorised personnel.

The user is invited to check the balance of his credits and to promptly report any errors or discrepancies by writing to info@nauticas.ch.

Receivables are not transferable to third parties, unless otherwise authorized in writing by Nautica’s Services SAGL. Receivables may not be automatically converted into cash, refunded, or assigned, unless otherwise agreed in writing or required by applicable law.

Nautica’s Services SAGL reserves the right to correct any material, technical or administrative errors relating to the uploading, display or theft of credits.

4. Booking the boats

Registered users can use the site to request or make reservations for boats, subject to availability, operating rules and conditions established by Nautica’s Services SAGL.

The reservation may be subject to the actual availability of the boat, weather conditions, technical, maintenance, organizational or safety requirements.

Nautica’s Services SAGL reserves the right to refuse, modify, cancel or reschedule a booking if this is necessary for technical, meteorological, safety, organisational, administrative reasons or for reasons of force majeure.

The user is required to arrive punctually at the agreed place and time. Delays, no-shows or non-compliant use of the service may result in the total or partial loss of credits related to the booking, according to the rules communicated by Nautica’s Services SAGL.

5. Conditions of use of the boats

The use of the boats is subject to compliance with the instructions provided by Nautica’s Services SAGL, safety regulations, any applicable port, lake or nautical regulations and specific conditions communicated before or during the service.

The user undertakes to use the boats with diligence, prudence and compliance with the applicable rules, avoiding dangerous, negligent or contrary to the instructions received.

Nautica’s Services SAGL may request documents, authorisations, confirmations, declarations or information from the user that are necessary to assess the suitability for use of the service or the boat.

If the user does not comply with the instructions, is unable to use the service safely or behaves inappropriately, Nautica’s Services SAGL may refuse or interrupt the service, without this automatically entailing a right to reimbursement or recovery of the credits used.

6. Your Responsibilities

The user is responsible for the correctness of the data provided, the use of their account, the reservations made and compliance with the instructions received from Nautica’s Services SAGL.

The user undertakes not to use the site or the services for any unlawful, fraudulent, abusive, harmful or contrary to these Terms and Conditions.

It is forbidden to attempt to access restricted areas of the site without authorization, interfere with the proper functioning of the platform, use unauthorized automatic tools, compromise the security of the site or upload harmful content.

7. Liability of Nautica’s Services SAGL

Nautica’s Services SAGL undertakes to manage the site and services with reasonable diligence, compatibly with the technical and organizational nature of the functions offered.

However, Nautica’s Services SAGL does not guarantee that the site will always be available, free of errors, interruptions, delays, malfunctions or technical incompatibilities.

The site may be temporarily suspended or limited for maintenance, updates, technical problems, security reasons or causes beyond the control of Nautica’s Services SAGL.

To the extent permitted by applicable law, Nautica’s Services SAGL cannot be held liable for indirect damages, loss of data, loss of use of the service, loss of opportunities, technical interruptions or consequences resulting from improper use of the site or user account.

8. Prices, packages and payments outside the site

Any prices, packages, credits or economic conditions relating to the services of Nautica’s Services SAGL can be communicated through the website, by e-mail, by telephone, in person or through other official channels.

Since the site does not operate as an e-commerce, any payments can be made outside the online platform, according to the methods agreed with Nautica’s Services SAGL.

Once the purchase, agreement or payment has been verified, Nautica’s Services SAGL can proceed to manually upload the credits to the user’s account.

Any errors in price, availability, description or loading of credits may be corrected by Nautica’s Services SAGL even after publication or display on the site.

9. Cancellations, Changes and No-Shows

The conditions relating to the cancellation, modification or rescheduling of bookings may vary depending on the type of service, the package purchased, the availability of the boats and the operating conditions.

The user is required to communicate any requests for cancellation or modification with adequate notice, by writing to info@nauticas.ch or using the channels indicated by Nautica’s Services SAGL.

In the event of a no-show, excessive delay or late cancellation by the user, Nautica’s Services SAGL may withhold the credits relating to the booking, unless otherwise decided or otherwise agreed in writing.

In the event of cancellation or modification for meteorological, technical, safety or organizational reasons attributable to Nautica’s Services SAGL, the company may propose a new date, the restoration of credits or other appropriate solution based on the specific case.

10. Weather, safety and force majeure

Boating activities can be affected by weather conditions, water levels, government regulations, navigation safety, boat maintenance or other factors that are not always predictable.

Nautica’s Services SAGL reserves the right to cancel, postpone, modify or interrupt a reservation if it considers that the appropriate conditions for the safe performance of the service do not exist.

Nautica’s Services SAGL shall not be liable for delays, cancellations or inability to perform the service due to force majeure, natural events, adverse weather conditions, measures of the authorities, sudden technical failures, emergencies, strikes, interruptions of essential services or other events beyond its reasonable control.

11. Site Content

The content on the site, including text, images, photographs, graphics, logos, trademarks, documents, service descriptions and information materials, is provided for informational purposes only and may be changed at any time.

Nautica’s Services SAGL undertakes to keep the information up to date and correct, but does not guarantee the absolute absence of errors, omissions or out-of-date information.

The images and descriptions on the website may be illustrative in nature and do not necessarily represent the actual availability, characteristics or conditions of the services offered.

12. Intellectual Property

All the contents of the site are the property of Nautica’s Services SAGL or their respective owners, unless otherwise indicated.

Copying, reproduction, distribution, modification, publication, transmission or use of the contents of the site for commercial or unauthorized purposes is prohibited without the prior written consent of Nautica’s Services SAGL or the holders of the relevant rights.

13. Multilingual system and translations

The site can be available in multiple languages through WPML or similar tools.

Translations are provided for ease of reference by users. In the event of discrepancies, inconsistencies or differences in interpretation between the different language versions, the Italian version shall prevail, unless otherwise expressly indicated.
